.SE (The Internet Infrastructure Foundation) is a private foundation with responsibility for the Internet’s top-level domain .se. Its proceeds are used to finance the continued development of the Internet in Sweden. In 2009, proceeds amounted to SEK 38.5 M and will be slightly higher in 2010.
Operations comprise two areas:

“.SE (The Internet Infrastructure Foundation) is an independent non-profit organization with responsibility for Sweden’s top-domain .se including the registration of (more than one million) .se domain names, and the administration and technical maintenance of the national domain name registry.
Proceeds from the fees charged by the foundation are allocated in their entirety to research, training and education in IT and telecommunications, with a particular focus on the Internet.
The organization is characterized by its executive management who, through their own personal commitment, serve as positive role models for all members of staff that actively participate in the customer-driven advancement of the organization. This is strengthened by a well-conceived and established system for recognition and encouragement.

The 28:th of september the board of registrars.se has, based on a statement from the ethics group, warned a member of potential problems with their adherence to the Ethicals guidlines and asked them for a reply.
To discourage others to do the same mistake we will publish the mail and the statement from the ethical group (Only in swedish).

Etikgruppens uttalande:
Registrars.se’s etikgrupp anser att XXXX överträder Etiska Reglerna §3 “Under inga förhållanden får Registraren till (klient), motpart, myndighet eller annan lämna uppgift, eller framföra ett påstående, som han vet är osant eller oriktigt.” Detta speciellt genom att skriva “Ärende: Varning fel registrar”, eftersom domänen är flyttad till annan Registrar för lång tid sedan (6+ månader).
Registrars.se’s etikgrupp anser också att XXXX överträder Etiska Regler §4 om God marknadsföringssed då man kontaktar en kund som man inte har vad gäller att flytta domäner till sig. Speciellt “motverka oriktiga påståenden, oetiska metoder, vilseledande uppgifter”, dels genom att kontakta kunden, dels genom att informera om “fel registrar” och att dessutom be kunden byta registrar så för det tanken till reklam.
Det är dock en förmildrande omständighet att kunden tidigare har haft en relation med XXXX och att det därför kanske har en teknisk orsak till att kunden kontaktades. Texten i mailet borde därför vara annorlunda och att det finns fog för XXXXX att korrigera sitt kundregister vad gäller aktiva och inte aktiva kunder.

Etikgruppen inom Registrars.se har tittat på de utskick som XXXXXX
har gjort under tidig höst 2010. Och anser att utskicken inte står i
linje med de etiska regler som man förbinder sig att följa genom att man
är medlem i Registrars.se
§3 Uppriktighet
I sin verksamhet skall Registraren uppträda sakligt och korrekt samt på
ett sådant sätt att aktning och förtroende för Registrarkåren och
verksamheten upprätthålls. Under inga förhållanden får Registraren till
(klient), motpart, myndighet eller annan lämna uppgift, eller framföra
ett påstående, som han vet är osant eller oriktigt.
Det är uppenbart att det i det utskickade materialet brukas en taktik
där man försöker påverka mottagare att genomföra en .se registrar
transfer av domänen, som baseras på ett hot om avregistrering av
domänen(“lämna uppgift, eller framföra ett påstående, som han vet är
osant eller oriktigt”).
Etikgruppen anser dock att det skulle vara en acceptabel tjänst till
sina egna kunder, men då man här fiskar efter kunder hos andra
registrarer går det utanför gränsen till de etiska reglerna.
§4 Marknadsföring
Registraren skall följa det lagar och förordningar som gäller enligt
marknadsföringslagen. Marknadsföringslagen ställer krav på att
registrarens marknadsföring ska stämma överens med det som kallas “god
marknadsföringssed”. Det betyder att lagen ska motverka oriktiga
påståenden, oetiska metoder, vilseledande uppgifter och andra oärliga
grepp i reklam och marknadsföring. Skulle medlem i registrars föreningen
bryta mot dessa regler förbehåller sig styrelsen i registrars föreningen
rättigheten att utesluta denna medlem ur registras föreningen.
Samtliga etiska regler vad gäller god marknadsföringsetik som är nämnt i
denna paragraf “oriktiga påstående, oetiska metoder, vilseledande
uppgifter och andra oärliga grepp i reklam och marknadsföring” kan anses
vara överträdda.
1) oriktigt påstående, ja, ditt domännamn är inte i fara, men skall bara
uppdateras
2) påverkan av andra registrarers kunder med vilseledande upplysningar
anses vara oetiskt
3) vilseledande uppgifter/marknadsföring
Beteendet ger associationer till DROA´s (Domain Regsitry of America)
brev som regelbundet belastar supporten hos registrarer. Även
XXXXX´s förfarande belastar supporten på andra registrarer.

September 29th, 2009 — Nyheter
Den 28/9 skickade vi från registrars.se ett nytt brev till PTS där vi ställer nytterligare 2 frågor med anledning av deras krav till IIS att förgranska domäner som innehåller bokstavskombinationen “bank”.
Vi känner att en hel del av våra frågeställningar inte blivit svarade på och att vi vill dels få igång en dialog med PTS samt svar på våra frågor.
Brevet finns publicerat uneder dokument på vår hemsida.
Nu har ju PTS meddelat i en pressmeddelande att dom dragit tillbaka sitt krav om detta, men vi vill fortfarande ha svar på frågorna och få igång en dialog med PTS.

Den 27 augusti 2009 offentliggjorde PTS att de anser att teckenkombinationen b-a-n-k i domännamn skall förhandsgranskas. .SE skall dessutom ha infört det till den 15 oktober och har fram till den 1 oktober på sig att berätta hur de tänker göra.
Hur PTS kommit fram till sina ställningstaganden är märkligt på många sätt. Detta är ett nytt område för PTS, det är den första tillsynen med stöd av Toppdomänslagen de gör och domännamnsfrågor är överhuvudtaget ett nytt område för dem.
När då PTS presenterar först en rapport med slutsatser som kritiseras på samma punkter från flera håll och därefter går vidare med ett yttrande som helt bygger på rapporten kan man inte låta bli att fundera på om de tagit till sig av kritiken?
